The "Terms and conditions" apply to legal transactions involving products sold to customers by BIOLIN sprl in its online store.

DEFINITIONS

Words or expressions below shall have under the present the following meanings:

Internet shop: means the website BIOLIN sprl on which the Products are presented and sold to clients.

Order: means the contract of sale between BIOLIN sprl and client Internet shop BIOLIN sprl.

Product Details: means information pertaining to a product provided by BIOLIN sprl during the sale of the product in its online shop.

Products: means all goods and services sold by BIOLIN sprl in its online shop.

Service: means the sale of Products by BIOLIN sprl customers to its Internet Boutique.

Transaction: means all operations, security processing, authorizations and agreements in connection with payment of the price of the Products ordered by credit card.

Article 1 - Purpose

These Terms of Sale are intended to define the terms and conditions under which BIOLIN sprl offers and sells its products to its customers.

These terms and conditions shall prevail over all other conditions contained in any other document, unless prior express written consent.

Article 2 - ACCEPTANCE OF TERMS

The customer acknowledges, at the time of placing an Order, the present general conditions of sale and expressly accept them without reservation.

These general terms of sale govern the contractual relationship between BIOLIN sprl and client, both parties accepting them without reserve.

Article 3 - PRODUCTS

The majority of products offered by BIOLIN sprl clients is immediately available.                                 

Article 4 - ORDER

The automatic registration systems are considered as proof of the nature, content and date of the Order.

BIOLIN sprl confirm the client's acceptance of the Order by sending a confirmation message to the email address that it will release. The sale will be concluded only after the dispatch of the order confirmation.

BIOLIN sprl reserves the right to refuse or cancel any order for a particular customer if said customer insolvency or in the event of a default of the Order concerned or of a previous delivery or a dispute over payment of a previous order .

In case exceptionally BIOLIN should be out of stock for one or more individual products BIOLIN reserves the right to satisfy and fulfill the order received by the client by sending to it is a product with features and identical functions , the same product but in different packaging and in the exceptional cases where this is not possible, BIOLIN will reimburse the customer for the order or products affected by the out of stock. However BIOLIN notify the customer by sending to it with the command notice temporarily out of stock . This notice will be attached to the product and therefore the order when shipping it. BIOLIN however, is not required to inform the date of availability of the product if it is not possible for any reason .

BIOLIN sprl can not be held responsible for errors made by the customer in the name and address of the recipient of the Order (delivery address, billing address in particular) and delays in delivery or failure to deliver the Products ordered these errors could result.

Article 5 - DELIVERY

After confirmation of the Order and subject to full payment of the price of products ordered, BIOLIN sprl undertakes to deliver to the client the ordered products to the delivery address and this exception unless the carrier chosen and the methods of delivery or recovery package that contains the order.

All Products set out in the placed orders to BIOLIN sprl are intended for the personal use of clients or recipients whose names are mentioned in the delivery address.

Where appropriate, the customer agrees to pay upon receipt, all taxes, duties, taxes and other charges present and future due for delivery of these products themselves, the joint liability of BIOLIN sprl shall in no way be held as such.

Clients or recipients of the products is strictly forbidden partial or total resale products.

In case of late delivery exceeding seven ( 7) days , the Customer may, if desired, except in cases of force majeure, terminate the contract of sale by registered letter with acknowledgment of receipt . This right must be exercised , however, within sixty (60) working days from the delivery date originally contracted days.

Upon receipt of the Products ordered , the customer or the recipient must verify the proper functioning of the goods supplied , and take note of the conditions of employment contained in the operating instructions supplied to it .

In the event that one or more of the Products ordered are missing or damaged , the customer or the recipient must make a claim with the carrier at the time of delivery .

In case of defects , the customer has the right to return under the conditions provided in the instructions for use of the property .

For reasons of availability of the Products ordered , an Order may be subject to several successive deliveries to the customer.

In the event that the client would like the Products to be delivered to two different addresses, then the latter 2 separate orders.

Article 6 - RETRACTATION - RETURNS

The customer has a period of 14 days from the receipt of the ordered products to return them to BIOLIN sprl against exchange or refund. In this case, the customer must return the new, sealed, intact or damaged products accompanied by their contents and / or any accessories, user instructions and documentation to the following address:

In case of exercise of the right of withdrawal, BIOLIN sprl undertakes to refund the sums paid by the customer, without expenses, except for the expenses of return.

The refund is due within a maximum of 14 days.

Article 7 - PRICE

Prices are expressed in euro.

The price shown on the product sheets does not include shipping fees.

The price indicated in the order confirmation is the final price including all taxes and VAT. This price includes the price of the Products, handling, packaging and storage of products, transportation costs and commissioning.

Article 8 - PAYMENT

The invoice price to the customer is the price indicated on the order confirmation sent by BIOLIN sprl price.

The Product price is payable by the proposed on-site the day of the payment order is effective.

Command validated by the customer will be considered effective until the secured bank payment center has given its approval to the transaction and, if necessary, following acceptance of management of risk by the insurer.

Article 9 - APPLICABLE LAW

These general terms of sale are subject to Belgian law and the courts of Brussels shall have exclusive jurisdiction.

Article 10 - LIABILITY

BIOLIN sprl can not be held responsible for damage of any kind, whether tangible or intangible property, which could result from a malfunction or improper use of the Products.

The responsibility of BIOLIN sprl will, in any event, exceed the amount of the order. In case of difficulties in the implementation of this contract, the client and BIOLIN sprl reserves the possibility, before any legal action to seek an amicable solution.

Otherwise, for business customers, the Commercial Court of Brussels has exclusive jurisdiction, regardless of the place of delivery and payment method accepted.

Article 11 - WARRANTY

In all cases BIOLIN sprl can not be held responsible for non-compliance with regulations and laws in force in the receiving country. The responsibility of BIOLIN sprl is always limited to the value of the product in question at the date of sale, and without recourse to the brand or manufacturer of the product.

In any case, the client receives the eviction and hidden defects under section 1625 and following of the Civil Code warranty.

ARTICLE 12 - LEGAL INFORMATION

The nominative information collected for purposes of distance selling is required, this information is essential for the processing and delivery of orders, preparing invoices and warranty contracts. Lack of information leads to the non-validation of the Order.

Accordance with the law "and Freedoms", the processing of personal information about customers has been declared to the Commission Nationale Informatique et Libertés (CNIL).

The customer has (article 34 of the law of January 6, 1978) a right to access, modify, rectify and delete data concerning him, he can exercise with BIOLIN sprl. In addition, BIOLIN sprl undertakes not to provide free or in exchange of information on its customers to third parties.
